Water Efficiency Projects Eligible for Qualified Energy Conservation Bonds Under the ARRA

Under the American Recovery and Reinvestment Act of 2009 (ARRA), $3.2 billion is provided in bond authority for the Qualified Energy Conservation Bond (QECB) Program. Water Efficiency projects qualify under the language in the ARRA, specifically the Conference Report. Page 627 of the Conference Report contains the pertinent language. It reads, “…Retrofits can include heating, cooling, lighting, water-saving, storm water-reducing, or other efficiency measures.” Please note, the guidance document for QECBs (Notice 2009-29) does not contain language related to water saving projects. However, they do qualify in accordance with the language in the ARRA Conference Report.
